At Ag Credit, we recognize your expectation of privacy and confidentiality of personal financial information when seeking the assistance of outside professionals to obtain credit. We have taken great care in establishing and implementing policies and procedures and have committed to an ongoing review of those policies and procedures to protect your personal and financial information.

Your privacy is a top priority in all aspects of our business. Our employees are informed of their responsibility to protect your confidential information and are governed by strict standards of conduct, which prohibit unauthorized use of your information. Security procedures and internal controls are also in place to protect your privacy. 

On this site, we collect personally identifiable information (such as name, address, SSN) only if specifically and knowingly provided by you. We do not give, sell or transfer any personal information to third parties. 

Information Collected and Stored Automatically

On our website, we collect and store information about your visit for security reasons, as well as for site research and enhancement. We do not track or record information about individuals and their visits. Through the use of Cookies (a file placed on your hard drive by a Web site that allows it to monitory your use of the site), we automatically collect and store only the following information about your visit: 

  • Your internet domain (for example, "xcompany.com") if you use a private Internet access account and IP address (an IP address is a number that is automatically assigned to your computer whenever you are surfing the Web) from which you access our site;
  • The type of browser and operating system used to access our site;
  • The date and time you access our site;
  • The pages you visit;
  • If you linked to our site from another Web site, the address of that Web site;
  • The authenticated username.

Information Collected from Emails and Web Forms

If you complete one of our interactive forms or submit an email through our website, your information will be used as described at the point of collection. It will be seen and used by employees of Ag Credit, but will not be provided to a third party. If you are not comfortable providing the requested information to Ag Credit via email or web forms, please contact us by calling 859-253-3249, or by writing to us at Post Office Box 1290, Lexington, KY  40588-1290.

We will not obtain personally-identifying information about you when you visit our site, unless you choose to provide such information to us.  Ag Credit limits the use and collection of all information to that which is necessary to maintain and administer financial services, provide excellent service, and offer new products and services that may be of benefit to you. We may use third party suppliers and/or service providers to facilitate our services. For example, we may outsource one or more aspects of our site to a supplier or service provider who performs services according to our requirements. In all cases we restrict how these suppliers or service providers may access, use or disclose your information. In general, we do not permit these suppliers or service providers to retain, disclose or sell your information to third parties.

Security, Intrusion, and Detection

For Web site security purposes and to ensure that this site remains available to all users, traffic on the site is monitored to identify unauthorized attempts to upload or change information, or cause damage. Unauthorized attempts to upload or change information on to this website are strictly prohibited, and may be punishable under the law. 

Children’s Online Privacy Protection

Our privacy policy only addresses our activities from our web site. This website is not directed at children nor do we collect any personally identifiable information from children.  If a parent or guardian becomes aware that his or her child have provided personal information without their consent, he or she should promptly contact us at 859.253.3249 and we will delete such information from our files.  For more information about the Children’s Online Privacy Protection Act (COPPA) visit ftc.gov,  online.

Weblinking

We may provide links to independent websites maintained by various federal agencies or other organizations, solely as a benefit to our customers.  These other sites may have their own policies, which we do not control, and thus are not addressed by our policy. We do not endorse, approve or guarantee information, products, services, or recommendations provided at any of the sites to which we have provided links.

We are not responsible for the content or accuracy of any of these links sites nor are we responsible for any loss or damage of any sort resulting from the use of a link on any linked websites. We are not liable for any failure of products or services advertised or provided on these linked sites. We offer these links on an "as is" basis.

Legal Requirements

Federal or State law, or regulations, may require us to disclose confidential information in certain situations. Such situations include requests from law enforcement agencies or criminal or civil legal proceedings. We reserve the right to disclose any information we deem necessary to comply with any applicable law, regulation, legal process or governmental request, including personally identifiable information.

This policy was last modified in June 2019.  When we change our Privacy Policy, we will post the revised policy here.   As we may make changes at any time without notifying you, we suggest that you periodically consult this Privacy Policy.

California Consumer Privacy Act

This PRIVACY NOTICE FOR CALIFORNIA RESIDENTS supplements the information contained in the Central Kentucky Ag Credit Privacy Policy and applies solely to visitors, users, and others who are residents of the State of California pursuant to Section 17014 of Title 18 of the California Code of Regulations (“consumers” or “you”). We adopt this notice to comply with the California Consumer Privacy Act of 2018 (“CCPA”) and other applicable California privacy laws.  Any terms defined in the CCPA have the same meaning when used in this notice.

Information We Collect

We collect information that identifies, relates to, describes, references, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or device (e.g. desktop or laptop computer, smart phone, or similar device) (“personal information”). In particular, we have collected the following categories of personal information from consumers within the last twelve (12) months:

Personal information does not include:

  • Publicly available information from government records.
  • De-identified or aggregated consumer information.
  • Information excluded from the CCPA's scope, like:
    • Health or medical information covered by the Health Insurance Portability and Accountability Act of 1996 (HIPAA) and the California Confidentiality of Medical Information Act (CMIA) or clinical trial data;
    • Personal information covered by certain sector-specific privacy laws, including the Fair Credit Reporting Act (FRCA), the Gramm-Leach-Bliley Act (GLBA) or California Financial Information Privacy Act (FIPA), and the Driver's Privacy Protection Act of 1994.

Central Kentucky Ag Credit obtains the categories of personal information listed above from the following categories of sources:

  • Directly from you. For example, from forms, verbal questions and answers, or online submissions that you have completed and provided to us related to the services you inquire about or engage us to perform.
  • Indirectly from you. For example, through information we collect from our clients, vendors, or third parties in the course of providing services to you.
  • Directly and indirectly from activity on our websites and applications. For example, from submissions through our website portal or website usage details collected automatically.
  • Publicly available data bases.

Use of Personal Information

Central Kentucky Ag Credit may use or disclose the personal information we collect, for either itself or its business partners or associations, for one or more of the following business purposes:

  • To fulfill or meet the reason for which the information is provided. For example, if you share your name and contact information while inquiring about our services, requesting information or materials, or ask a question about our products or services, we will use that personal information to respond to your inquiry.
  • To provide you with information, products or services that you request from us.
  • To process your requests, transactions, and payments and prevent transactional fraud.
  • To carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collections.
  • To improve our website and present its contents to you.
  • For testing, research, analysis and product development.
  • As necessary or appropriate to protect the rights, property or safety of us, our clients or others.
  • To respond to law enforcement requests and as required by applicable law, court order, or governmental regulations.
  • As described to you when collecting your personal information or as otherwise set forth in the CCPA.

Central Kentucky Ag Credit will not collect additional categories of personal information or use the personal information we collected for materially different, unrelated, or incompatible purposes without providing you any required notice.

Sharing Personal Information

Central Kentucky Ag Credit may disclose your personal information to a third party for a business purpose.  When we disclose personal information for a business purpose, we may enter a contract that describes the purpose and requires the recipient to both keep that personal information confidential and not use it for any purpose except performing the contract.

In the preceding twelve (12) months, we may have disclosed the following categories of personal information for a business purpose:  Categories A, B, C, D, E, F, I, J

We disclose your personal information for a business purpose to the following categories of third parties:

  • Legal entities established pursuant to the Farm Credit Act of 1971.
  • Contracts and service providers.
  • Third parties to whom we partner to offer products and services to you.

In the preceding twelve (12) months, we  have not sold any personal information.

Your Rights and Choices

The CCPA provides consumers (California residents) with specific rights regarding their personal information. This section describes your CCPA rights and explains how to exercise those rights.

Access to Specific Information and Data Portability Rights

You have the right to request that we disclose certain information to you about our collection and use of your personal information over the past 12 months. Once we receive and confirm your verifiable consumer request, we will disclose to you:

  • The categories of personal information we collected about you.
  • The categories of sources for the personal information we collected about you.
  • Our business or commercial purpose for collecting or selling that personal information.
  • The categories of third parties with whom we share that personal information.
  • The specific pieces of personal information we collected about you (also called a data portability request).
  • If we sold or disclosed your personal information for a business purpose, two separate lists disclosing:
  • Sales, identifying the personal information categories that each category of recipient purchased; and
  • Disclosures for a business purpose, identifying the personal information categories that each category of recipient obtained.

Deletion Request Rights

You have the right to request that we delete any of your personal information that we collected from you and retained, subject to certain exceptions. Once we receive and confirm your verifiable consumer request, we will delete (and direct our service providers to delete) your personal information from our records, unless an exception or good faith, commercially reasonable business justification applies.

We may deny your deletion request if retaining the information is necessary for us or our service providers to:

  1. Complete the transaction for which we collected the personal information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract with you.
  2. Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities.
  3. Debug products to identify and repair errors that impair existing intended functionality.
  4. Exercise free speech, ensure the right of another consumer to exercise their free speech rights, or exercise another right provided for by law.
  5. Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 seq.).
  6. Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information's deletion may likely render impossible or seriously impair the research's achievement, if you previously provided informed consent.
  7. Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us.
  8. Comply with a present or potential legal obligation.
  9. Make other internal and lawful uses of that information that are compatible with the context in which you provided it.

Exercising Access, Data Portability, and Deletion Rights

To exercise the access, data portability, and deletion rights described above, please submit a verifiable consumer request to us by either:

Only you or a person registered with the California Secretary of State that you authorize to act on your behalf, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child.

You may only make a verifiable consumer request for access or data portability twice within a 12-month period. The verifiable consumer request must:

  • Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative.
  • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We cannot provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you. 

Making a verifiable consumer request does not require you to create an account with us. 

We will only use personal information provided in a verifiable consumer request to verify the requestor's identity or authority to make the request.

Response Timing and Format

Pursuant to the CCPA we will attempt to respond to a verifiable consumer request within forty five (45) days of its receipt.  If we require more time (up to 90 days), we will inform you of the reason and extension period in writing. 

We will deliver our written response by mail or electronically, at your option. 

Pursuant to the CCPA any disclosures we provide will only cover the twelve (12) month period preceding the verifiable consumer request's receipt.  The response we provide will also explain the reasons we cannot comply with a request, if applicable.

We typically do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded.  If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

Non-Discrimination

Central Kentucky Ag Credit will not discriminate against you for exercising any of your CCPA rights. Unless permitted by the CCPA, we will not:

  • Deny you goods or services.
  • Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties.
  • Provide you a different level or quality of goods or services.
  • Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.

Changes to Our Privacy Notice

We reserve the right to amend this privacy notice at our discretion and at any time. When we make changes to this privacy notice, we will notify you through a notice on our website homepage. Your continued use of our Website following the posting of changes constitutes your acceptance of such changes.

Anonymous Reporting

Ag Credit is committed to high standards of ethical, moral and legal business operations and having the confidence of its employees, shareholders, FCA, contractors and other relevant parties in this commitment. As such, we provide a confidential, anonymous reporting system as an alternate channel of communication for reporting suspected or actual wrongdoing, concerns and feedback. An independent, external party receives and processes the reports to ensure objectivity and anonymity.

  • Accounting & Finance
  • Claims & Benefits
  • Conflict of Interest
  • Corporate waste

Once a report is submitted, a case number is assigned to provide a way for the reporter to check the status of their report and to be contacted anonymously for additional information, if needed.

Those using the reporting system are expected to make reports in good faith. Ag Credit strictly prohibits discrimination, retaliation or harassment against any individual who, in good faith, reports or who participates in an investigation of wrongdoing, concerns, or feedback.

Code of Ethics

Central Kentucky Agricultural Credit Association's Code of Ethics establishes high ethical standards for professional conduct for directors and employees, including requiring all directors and employees to avoid and disclose any conflicts of interest.
